Section 149 Planning Certificate

Before proceeding, please read and signify your agreement to the following terms and conditions.

Terms and Conditions

From 1 October 2014, Georges River Council has changed how Section 149 Planning Certificates are issued for all residential, commercial business and industrial land in the Hurstville local government area, with the exception of the Hurstville City Centre.

Section 149 Planning Certificates are only available online.

Georges River Council’s electronic service relies on the Internet to receive applications for Section 149 planning certificates. Certificates are generated at Council’s Offices and are emailed. Access to the Internet by users of the service is dependent on numerous factors, technologies and systems, many of which are beyond Council’s authority and control. Georges River Council will not be liable or responsible for any inability of yours to access the Internet.

When you apply for a Section 149 certificate, you must accurately identify the land by reference to its legal description (being a Lot, Section and Deposited Plan and/or Strata Plan). It is your responsibility to check the contract, mortgage, survey or other relevant documents to verify that you have accurately identified the land to which your application relates. The legal description of land can be obtained from the Department of Lands Website . Council will not check the accuracy or currency of this information.

Certificates will not be issued to any other person without authorisation from the applicant.

Georges River Council excludes any liability to you and any third party arising from or relating to the above and/or in any way relating to:
   1. any act or omission of Georges River Council in good faith and without negligence;
   2. the failure of Georges River Council to receive any instructions, information or document by a particular time or at all unless the failure was the result of a negligent act or omission of Georges River Council; or
   3. any act or omission of a third party including, without limitation, a telecommunications or Internet service provider.

If you have not received a certificate you have applied for or believe that the certificate you have received has been corrupted or damaged, please contact Georges River Council on (02) 9330 6400.

All matters relating to this service are governed by the laws of the State of New South Wales.
